RecoverKit is a SaaS platform that connects to your Stripe account via API key and automatically recovers failed payments through smart retry logic and personalized dunning email sequences. The service includes:

• Automated failed payment detection via Stripe webhooks
• Decline code classification and smart retry scheduling
• Customisable dunning email sequences via Resend
• Recovery analytics and reporting dashboard
• Secure Stripe API key storage with AES-256-GCM encryption

We do not guarantee any specific recovery rate. Results depend on your customers' payment methods, bank policies, and decline reasons.

You must create an account to use RecoverKit. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep it up to date. You must be at least 18 years old to use this service.

RecoverKit offers subscription plans billed monthly or annually. By subscribing, you authorise us to charge the applicable fee to your payment method on a recurring basis.

• Subscription fees are charged at the start of each billing period.
• We do not charge a commission or percentage of recovered payments.
• A 14-day free trial is offered on all paid plans. No credit card required during trial.
• After the trial, you will be billed automatically unless you cancel.
• Payments are processed by Stripe. We do not store card details.

You may cancel your subscription at any time from the billing portal in your dashboard. Cancellation takes effect at the end of the current billing period — you retain full access until then.

Refunds: We do not offer pro-rated refunds for unused time within a billing period. Exceptions may be made at our sole discretion for extenuating circumstances. To request a refund, contact help@dviewb.com within 7 days of the charge.

You agree not to:

• Use the service for any unlawful purpose or in violation of Stripe's Terms of Service
• Attempt to reverse-engineer, decompile, or extract our source code
• Resell or sublicence the service without written consent
• Use the service to send spam or unsolicited communications
• Interfere with the integrity or performance of the service
• Upload malicious code or attempt to gain unauthorised access to our systems

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

All content, software, trademarks, and intellectual property within RecoverKit are owned by or licensed to DviewB - Mycd. You are granted a limited, non-exclusive, non-transferable licence to use the service for its intended purpose during your subscription.

Your data (including your customers' payment records) remains yours. We claim no ownership over data you input into the platform.

To the fullest extent permitted by applicable law, DviewB - Mycd shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Lost profits, revenue, or business opportunities
• Losses arising from your use of or inability to use the service
• Errors or interruptions in third-party services (Stripe, Resend, Supabase, Clerk)
• Unauthorised access to or alteration of your data caused by factors outside our control

Our total cumulative liability to you shall not exceed the total fees paid by you in the 12 months preceding the claim.

DviewB - Mycd acts as a data processor with respect to your customers' personal data (emails, names) received via Stripe webhooks. You are the data controller and are responsible for ensuring you have a lawful basis to share this data with us.

By using RecoverKit, you enter into a Data Processing Agreement (DPA) with us as required by GDPR Article 28. We process your customers' data solely for the purpose of sending dunning emails on your behalf and will not use it for any other purpose.

We aim for 99.5% uptime but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance. We are not liable for downtime caused by third-party infrastructure (Stripe, Vercel, Supabase) or events beyond our reasonable control.

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Continued use of the service after changes constitute acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of Italy. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Italy.
